It is your right to go/come to Australia and be with your beloved one. But it has been very common of late that subsequent visa application from Nepal has been refusing in alarming rate. This is how you get subsequent student visa granted. In this visa application there are two factors to be focused on.

1. Genuine Temporary Entrant-Needs to be positively assessed
2. Spouse/Partner –Genuine and Continuing relationship.

Genuine Temporary Entrant (GTE)– As we are applying for subclass 500 student subsequent visa , applicant must be assessed positively on GTE assessment. Department’s  case officers relay on ministerial direction 69 to determined if the applicant can be assessed positively .We suggest an applicant to consider on providing evidence to provide convincing reasons that your intention is to genuinely reside  Australia temporarily  based on following  facts.

Previous study

• academic transcripts showing qualifications achieved
• name of the education provider(s)
• length of study
• certificates of attainment

Employment-history, current and potential

• your previous , current and potential employer
• company address
• period of employment
• details of your position
• details of remuneration
• the name and contact details of someone who can confirm the circumstances of your employment
• Proof of grant of holiday or letter stating that the employment is on offer  once the applicant returns back.

Ties to home country or country of residence

• Evidence of financial, family or social ties. You need to show you have significant incentives to return home
• income tax return or bank statements

Other factor to focus on is to prove relationship is genuine and continuing. Regulation prescribes following aspects to be satisfied as a spouse/partner relationship.

1. Financial-

• • any joint ownership of real estate or other major assets; and
  • any joint liabilities; and
  • the extent of any pooling of financial resources, especially in relation to major financial commitments; and
  • the basis of any sharing of day-to-day household expenses

2. Social

• • whether the persons represent themselves to other people as being married to each other; and
  • the opinion of the persons’ friends and acquaintances about the nature of the relationship; and
  • any basis on which the persons plan and undertake joint social activities; and

3. Nature of Household-

• • any joint responsibility for the care and support of children; and
  • the living arrangements of the persons; and
  • any sharing of the responsibility for housework; and

4. Commitment for each other–

• • the duration of the relationship; and
  • the length of time during which the persons have lived together; and
  • the degree of companionship and emotional support that the persons draw from each other; and
  • whether the persons see the relationship as a long-term one.
